These Terms of Service ("Terms") govern your use of menup.me ("menup", "the Service") operated by Digital Software Co. By creating an account or placing an order, you agree to be bound by them. If you do not agree, do not use the Service.
menup is a multi-tenant SaaS platform that lets restaurants run their menu, orders, kitchen display, customer chat, and payments from one place. We are a technology provider. We do not prepare, sell, or deliver food. Each restaurant is solely responsible for the food it serves, the prices it charges, and the orders it accepts.
You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account. You are responsible for the accuracy of your account information and for keeping your credentials confidential. You are responsible for everything that happens under your account.
Restaurant owners are responsible for the actions of any staff members they invite, including ensuring those staff respect this agreement and applicable law.
menup is offered on Free, Pro, and Enterprise plans. Plan limits and prices are listed on /pricing and may change with notice. The plan you are on at the time of each renewal applies for that billing cycle. Pricing is in Omani Rial (OMR) unless stated otherwise, and is exclusive of any applicable VAT, which we will add at the rate in force on the date of invoice.
Subscription fees are charged monthly in advance and are non-refundable except where required by law. You can cancel at any time from your dashboard; cancellation takes effect at the end of the current billing cycle and your data remains accessible until then.
When a diner pays a restaurant through menup using PayPal or Stripe, the funds are handled by the payment provider, not by menup. menup may charge the restaurant a platform fee on each successful transaction; the fee rate is shown in the restaurant's plan and on each receipt.
Refunds for completed orders are issued by the restaurant. menup provides the tooling but does not adjudicate disputes between a diner and a restaurant about food quality, delivery, or cancellations — those are the restaurant's responsibility.
You agree not to:
You retain ownership of everything you upload — menu items, photos, branding, descriptions. You grant menup a non-exclusive, worldwide, royalty-free license to host, display, and adapt that content for the sole purpose of operating the Service for you. We do not use your content for marketing other restaurants without your written permission.
You represent that you have the rights to anything you upload (you took the photos, you wrote the descriptions, or you have permission from whoever did).
We may suspend or terminate an account that violates these Terms or that, in our reasonable judgement, poses a security or legal risk to the platform. We will give reasonable notice except in cases of urgent or repeated abuse.
On termination, you can export your data for 30 days. After that we delete it in line with our Privacy Policy retention schedule.
The Service is provided "as is". We make no warranty that the Service will be uninterrupted, error-free, or fit for any particular purpose. We do not warrant the accuracy of any restaurant's menu, prices, or open hours — those are entered by the restaurants themselves.
To the maximum extent permitted by Omani law, menup's aggregate liability to you for any claim arising out of or related to these Terms or your use of the Service is limited to the greater of: (a) the fees you have paid to menup in the 12 months preceding the claim, or (b) OMR 100. menup is not liable for indirect, consequential, or punitive damages, lost profits, or lost data, even if we have been advised of the possibility.
These Terms are governed by the laws of the Sultanate of Oman. Any dispute that cannot be resolved between us will be submitted to the exclusive jurisdiction of the competent courts of Muscat.
We may update these Terms from time to time. Material changes will be notified to account holders by email at least 30 days before they take effect. Continuing to use the Service after that date constitutes acceptance.
